Some investors have remarked that since there already is a class action pending (which we have brought), why should they themselves join the class action as a class representative?
The answer is two-fold. First, class action participation allows the class rep to be involved in the actual prosecution of the case, strategy, settlement and so forth. In other words, it reflects the difference between caring about the results versus not caring about the results. Anyone who cares about their investment in Apple REIT 9 and/or 10 and who has more than a few thousand dollars invested should want to take part as a class representative.
Second, it does not matter that a class representative already is in place. That’s because it always is preferred to have several class action plaintiffs on board.
